End User License Agreement (EULA) for EyeFit AppThis End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and SkillRush Inc. ("Company", "we", "us", or "our") regarding your use of EyeFit App ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to the Agreement, do not use the App.
1. License GrantThe Company grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with the terms of this Agreement.
2. RestrictionsYou agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make the App available to any third party.
- Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.
- Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of the Company or its affiliates, partners, and licensors.
- Copy, modify or distribute any of the App content.
3. Medical DisclaimersApp is provided solely for informational purposes and is not intended to diagnose, prevent, or treat any medical condition or disease, nor is it a substitute for professional medical care.
App is not a licensed medical provider and does not engage in diagnosing, examining, or treating medical conditions, nor does it prescribe treatments or evaluate the effects of any treatment on medical conditions.
App does not offer emergency services and has no obligation to contact you or any other individual regarding your medical condition or treatment.
The accuracy, reliability, effectiveness, or proper use of any services provided by App are not guaranteed. Always consult a medical professional with any questions or concerns about a medical condition. Never disregard professional medical advice or delay seeking it because of information obtained from the App.
Activities described within the App may not be suitable for everyone. Do not use the App while driving, operating heavy machinery, or performing other tasks that require full attention and concentration. You are solely responsible for your use of the App.
4. No WarrantyThe App is provided on an "AS IS" and "AS AVAILABLE" basis. The Company disclaims all warranties and conditions with regard to the App, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
5. Limitation of LiabilityIn no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.
6. TerminationThis Agreement is effective until terminated by you or us. We may terminate or suspend your license to use the App at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms of this Agreement.

8. Premium Subscription Terms8.1 Free PlanFree (Basic) Plan allows you to use the app for free for 90 seconds a day.
8.2 Subscription OptionsEyeFit App offers various subscription levels, including a Premium Subscription, which unlocks additional features and capabilities within the app. The Premium Subscription is available through different plans: monthly, yearly, and lifetime. Each subscription plan enhances the app’s functionality as described in the app's purchase section.
8.3 Subscription FeaturesThe Premium Subscription includes:
- No time limit per day for all exercises
- Access to high-quality content, including videos at higher frame rates (fps) if the increased fps allows you to improve the quality of the exercise.
- Regular updates and additions to exercise routines.
- Flexible reminder options to enhance your experience.
8.4 Auto-Renewal and PaymentYour Premium Subscription will automatically renew at the end of each subscription period, unless you cancel it at least 24 hours before the renewal date. Payment will be charged to your designated payment method at confirmation of purchase.
8.5 CancellationYou may cancel your Premium Subscription at any time. The cancellation will take effect the day after the last day of the current subscription period, and you will be downgraded to the free version of the app.
8.6 No RefundsPayments are nonrefundable, and there are no refunds or credits for partially used periods, except as required by law.
8.7 Changes to Subscription FeesSkillRush Inc. reserves the right to change the subscription fees at any time. We will notify you in advance of such changes becoming effective.
8.8 Rights ReservedSkillRush Inc. reserves the right to modify, suspend or discontinue the Premium Subscription service at any time without notice. In such cases, you will no longer be charged for the subscription.
8.9 Acceptance of Subscription TermsBy subscribing to the Premium service, you agree to the terms outlined in this section and the conditions provided in this Agreement. Failure to comply with these terms may result in the termination of your subscription.
9. Governing LawThis Agreement shall be governed and construed in accordance with the laws of State of Delaware, US, without regard to its conflict of law provisions.
10. Amendments to this AgreementWe reserve the right, at our sole discretion, to modify or replace this Agreement at any time. What constitutes a material change will be determined at our sole discretion.
